(hereinafter also referred to as "Platform" or "Campcruisers")
These conditions apply to all providers on the Campcruisers platform — in particular, lessors of vehicles and boats, operators of campsites and parking spaces, experience providers, and providers of vehicle listings — in addition to the General Terms of Use (ANB) of the Campcruisers platform.
(1) The provider ensures that the services offered (in particular rental vehicles, boats, parking and campsites, as well as leisure activities and experiences) are available during the specified period. All information regarding the offers must be correct, complete, and truthful. Offers set to "instant booking" must be kept available for immediate booking; inquiries without instant booking must be confirmed or declined within 72 hours.
(2) The provider must immediately inform Campcruisers of any contract-relevant changes (e.g., accident or theft of the vehicle, changes to service conditions). If the provider and the customer agree to change the rental period after the contract has been concluded, this must also be communicated to Campcruisers.
(3) The provider may remove offers at any time as long as no binding contract exists.
(4) Campcruisers reserves the right to request relevant documents or copies thereof from the provider, e.g., business registration, a current commercial register extract, vehicle registration documents, insurance certificates, or proof of authorization to conduct leisure activities.
(5) If a cancellation or payment is made outside the platform, the provider must immediately inform the platform.
(6) The provider is obligated to check their email daily.
(7) Campcruisers assumes no responsibility for the content, article texts, or other information provided by the providers.
(8) The provider is liable for the images, texts, and other content they upload. The provider guarantees that they have the necessary rights to the uploaded content and that these do not infringe on the rights of third parties.
Providers may not charge additional fees or other payments (e.g., for excess kilometers or special cleaning fees for heavily soiled rental vehicles) unless these are transparently and clearly stated before the conclusion of the contract. This includes specifying them in the respective contract conditions, the overview before booking, the product description, or the respective price overview. These details must be clearly stated alongside other payment claims (e.g., rental payment) to the customer.
(1) Campcruisers offers lessors of rental vehicles the following package options:

(2) For lessors using the ERP solution womoplus+, special conditions apply upon request.
(3) The commission is due on all payments made within the scope of the rental agreement. This also includes cancellation fees that the customer must pay due to contract cancellation.
(4) When booking a PRO package online, lessors receive a 14-day free trial period. Afterward, the package can be terminated with a notice period of 4 weeks before the end of the respective package period in text form. If the provider does not terminate the package at least 3 months before the end of the term, the package will be extended for the previous package term.
(5) The booking of a package can also be done via an order form, which the lessor sends to Campcruisers by fax, scan, or mail. For packages concluded via fax, email, or mail, there is no trial period unless otherwise agreed.
(6) The commission and payment claims of the platform against the lessor are due immediately after the conclusion of the rental agreement with the lessee, i.e., after successful payment of the booking.
(7) Offers can be set as "instant booking" or as an "inquiry," which must be answered within 3 business days.
(8) In the intermediary model (§ 1a para. 2 lit. a of the ANB), the lessor receives the booking amount minus the agreed Campcruisers commission 7 days after booking on their Stripe account. The commission is automatically withheld by the payment service provider and credited to Campcruisers.
(1) The following options apply to campsites and commercial parking spaces:

(2) For private parking spaces (e.g., on farms, wineries, or private properties), only the Performance Package applies, with a 12% commission on the successfully mediated gross revenue, plus VAT.
(3) The commission and payment claims of the platform against the provider are due immediately after the customer's successful payment of the booking.
(4) In the intermediary model, the provider receives the booking amount minus the agreed Campcruisers commission 7 days after booking on their Stripe account.
(5) The commission is due on all payments made within the scope of the booking agreement. This also includes cancellation fees that the customer must pay due to contract cancellation.
(1) Providers of leisure activities, attractions, and experiences (e.g., diving schools, museums, guided tours, outdoor activities) can offer their services for booking via the Campcruisers platform and mobile app.
(2) The Performance Package applies: 12% commission on the gross ticket price, plus 19% VAT.
(3) The commission and payment claims of the platform against the provider are due immediately after the customer's successful payment of the booking. Payment processing is handled via Stripe Connect (§ 5). The booking amount minus the Campcruisers commission is available on the provider's Stripe account 7 days after booking.
(4) The provider is responsible for the proper provision of the booked service. The provider's terms and conditions apply.
(5) Cancellation conditions are set by the provider and displayed to the customer before booking.
(6) Right of withdrawal: If a ticket or leisure activity is not tied to a specific day or period (e.g., annual passes, flexible vouchers), the customer has a statutory right of withdrawal according to § 312g BGB. The provider is obligated to clearly indicate in their offers whether the ticket is tied to a specific date. If the ticket is tied to a specific date, there is generally no right of withdrawal according to § 312g para. 2 no. 9 BGB.
(7) For attractions displayed via the redirection partner Viator (Tripadvisor Group), the conditions under § 12 of these BNB apply. The conditions of this section (§ 4a) apply exclusively to providers who register directly with Campcruisers.
(1) Campcruisers offers providers — particularly lessors who rent out their fleet via Campcruisers — the opportunity to list vehicles for sale. Campcruisers provides only an advertising platform for this purpose. No vehicles can be purchased via Campcruisers. There is no purchase processing or payment processing via the platform. Interested parties can only send a contact request via the ad, arrange an inspection appointment, or request a test drive. Any purchase agreement is concluded exclusively outside the platform directly between the provider and the interested party.
(2) Private sellers: Private individuals can list vehicles free of charge and without any limit on the number of ads or the sale price.
(3) Commercial providers (existing lessors): Providers who are already registered as lessors on the Campcruisers platform receive 3 free sales ads. Each additional ad costs 9.90 € net per month (duration of the ad).
(4) Commercial providers (ads only): Providers who use only vehicle ads receive 1 free sales ad. Each additional ad costs 14.90 € net per month (duration of the ad).
(5) Premium placement: Providers can highlight individual ads as premium ads. The fee is 19.90 € net per month in addition to any applicable ad fee. Premium ads are prioritized in search results and visually highlighted. Premium ads are marked as "Advertisement" according to § 5a UWG and the State Media Treaty.
(6) Rent-to-Own (Rent and Buy): Lessors who additionally mark a rental vehicle as "Rent and Buy" receive the associated sales ad permanently free of charge. Tenants who wish to purchase the vehicle after a completed rental booking can receive a rental credit toward the purchase price. The amount of the rental credit depends on the period between the return of the rental and the purchase interest: 100% of the net rental fee within 7 days, 75% within 8–30 days, 50% within 31–90 days. After 90 days, the rental credit expires. The purchase transaction takes place directly between the provider and the tenant.
(7) Commercial providers are obligated to provide complete provider identification according to § 5 DDG (formerly § 5 TMG). Without complete provider identification, no ads can be published.
(8) Commercial providers are obligated to provide all legally required information in their ads, in particular: mandatory information according to the Passenger Car Energy Consumption Labeling Ordinance (Pkw-EnVKV), transparent price information according to the Price Indication Ordinance (PAngV) including VAT information and, if applicable, reference to differential taxation according to § 25a UStG, warranty information (at least 12 months for commercial sales of used vehicles, 24 months for new vehicles). Since no vehicle can be purchased via Campcruisers, the provider is obligated to inform the interested party of their legal rights within the scope of any purchase agreement concluded outside the platform.
(9) Ad fees are billed monthly in advance via Stripe. The fee is due upon publication of the ad. If an ad is deactivated or deleted before the end of the billing period, no partial refund will be made.
(10) Campcruisers reserves the right to deactivate or delete ads that violate these terms of use, applicable law, or ad guidelines.
(1) Campcruisers works with Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland, as the payment service provider. Stripe ensures that payments from a customer to a provider via Campcruisers are processed securely and in compliance with the law, and that the payment is transferred to the lessor after deduction of the agreed commission.
(2) The provider is obligated to set up a Stripe account via the Campcruisers platform. Setting up the Stripe payout account is free of charge for the provider. During the registration process with Stripe, Stripe may request a copy of an ID, a business license, and possibly other documents for identity verification. Campcruisers has no influence on the documents required by Stripe.
(3) When booking a rental vehicle in the intermediary model (§ 1a para. 2 lit. a of the ANB), the lessee can decide whether to
The deposit option is not available if the booking period begins in less than 3 weeks. In this case, the full booking amount is due immediately.
(3a) For bookings in the self-distribution model (Tour Operator Model, § 1a para. 2 lit. d of the ANB), the full booking amount is always due immediately upon booking. A deposit is not possible in this case.
(4) Parking spaces and campsites are always paid in full by the customer immediately unless another option is offered.
(5) If the lessee has only made a deposit when booking the rental vehicle, the provider must inform the platform by email by when and to which account the lessee must pay the remaining amount to the lessor and, if applicable, provide additional security deposits (deposit).
(6) Invoices are issued electronically. A fee of 8 € plus VAT is charged for sending an invoice by mail instead of in text form.
(1) If the provider is based in a country where setting up a Stripe Connect account is not possible, or if the provider does not have a Stripe account for other reasons, Campcruisers may offer the provider the use of the Stripe platform account of Campcruisers GmbH for payment processing. Campcruisers reserves the right to refuse providers from countries without Stripe Connect support at its own discretion, particularly if the provider's seriousness or creditworthiness cannot be sufficiently proven.
(2) If the provider accepts this offer, they hereby authorize Campcruisers to receive payments from customers on behalf of and in the name of the provider on the business account of Campcruisers GmbH. This authorization includes the receipt, fiduciary custody, and forwarding of payments minus the agreed commission.
(3) In this model, the provider sets their own prices and vehicle data. The provider issues the invoice to the end customer. The rental agreement is concluded exclusively between the lessee and the provider. Campcruisers acts only as the authorized recipient of payments.
(4) The payout to the provider is made by bank transfer (if necessary via the service Wise) within 14 days of receipt of payment. Campcruisers is not liable for delays caused by the payment service provider or the provider's bank.
(5) For transfers in foreign currencies, the conversion is made at the exchange rate on the day of the transfer. Campcruisers does not guarantee against exchange rate fluctuations.
(6) Campcruisers may terminate the cooperation with providers without a Stripe account at any time with a notice period of 4 weeks in text form, particularly if there are doubts about the provider's seriousness or if Stripe Connect becomes available in the respective country.
(1) Campcruisers works with womoplus+, an ERP software for lessors of recreational vehicles. womoplus+ is operated by RMP GmbH, Kronacher Str. 94, 96052 Bamberg.
(2) Through womoplus+, bookings can be processed, invoices created, and availabilities managed centrally. This allows live availabilities to be controlled centrally across different booking portals.
(3) Lessors using womoplus+ have the opportunity to offer their vehicles for rent on Campcruisers via an interface (API).
(4) Lessors who use the womoplus+ software solution and wish to use it in conjunction with Campcruisers must conclude a separate contract with Campcruisers. Additionally, the lessors require a usage license for the womoplus+ software.
(5) To use Campcruisers in conjunction with womoplus+, the lessors must send the cooperation agreement with Campcruisers to Campcruisers and activate Campcruisers as a booking portal in their womoplus+ settings.
(6) Campcruisers offers lessors who use the womoplus+ software and do not wish to book a paid annual package a purely commission-based rate. Once the booking process begins, the booking is transferred directly from Campcruisers to womoplus+ for womoplus+ lessors.
(7) womoplus+ or the lessor will inform the lessee of the payment terms; as a rule, payment is made by bank transfer directly to the lessor.
(8) The lessor informs Campcruisers via womoplus+ that the booking was successful or paid.
(9) Campcruisers' commission claim arises upon receipt of the deposit or payment of the lessee on the lessor's bank account, which the lessor must promptly, i.e., without culpable delay, report in text form or via the platform.
(1) Campcruisers works with Wheeloffice, a software solution for the commercial rental of motorhomes and caravans. Wheeloffice is a product of Luca Veltmann, Drubbel 3, 48143 Münster.
(2) Lessors using the Wheeloffice software solution have the opportunity to offer their motorhomes and caravans for rent on Campcruisers via an interface (API).
(3) For successfully mediated bookings that are concluded via the Wheeloffice interface, the lessor pays a commission of 12% of the gross rental revenue to Campcruisers.
(4) Payment processing for bookings via the Wheeloffice interface is handled by the payment service provider mentioned in section 5 (Stripe). Therefore, a Stripe account linked to the Campcruisers platform is a prerequisite for use.
(5) The applicable commission is automatically withheld during the processing of the customer's payment and credited to Campcruisers.
(1) Campcruisers uses the software 5 Anker Connect, a CRM and ERP software for boat lessors or charter companies. 5 Anker Connect is operated by 5 Anker - Kommunikation für den maritimen Bereich GmbH, Ollenhauer Str. 98, 13403 Berlin.
(2) 5 Anker Connect offers lessors of boats various booking modules, programming interfaces (APIs) to various online portals, customer access, and tools for invoice, rebooking, and contract creation.
(3) Lessors using 5 Anker Connect have the opportunity to offer boats for rent on Campcruisers via an interface (API).
(4) Campcruisers is exclusively an intermediary. Mediated rental agreements are concluded exclusively between the lessee and the charterer.
(5) Campcruisers is not liable for the availability of the offered boats but will endeavor to support the customer if any irregularities regarding availability or other discrepancies become apparent.
(6) Campcruisers is obligated and authorized to receive payments from the customer on behalf of and in the name of the lessor and to use these payments for their intended purpose without delay.
(7) Campcruisers is entitled to issue invoices to customers in the name and on behalf of the lessor.
(8) The current commission rate can be viewed in the lessor's login area at 5 Anker. After each payment receipt (partial, deposit, or full payment), the lessor receives a corresponding notification and issues an invoice for payment, minus the due commission to Campcruisers. The payout to the lessor is made within 7 days of invoicing.
(1) For certain providers, Campcruisers operates under the tour operator model. In this case, Campcruisers receives payment from the end customer and issues its own invoice. The provider issues a B2B invoice to Campcruisers for the service provided.
(2) Campcruisers receives the prices from the provider via a programming interface (API) and is entitled to add a margin to the purchase price.
(3) The rental service is provided by the provider. The provider's rental conditions apply to the end customer on-site. The provider guarantees the proper provision of the rental service.
(4) The provider indemnifies Campcruisers against all claims by the end customer that are based on a defective service by the provider, unless Campcruisers is responsible for the defect.
(5) The following providers currently operate under the tour operator model:
(6) The inclusion of additional providers in the tour operator model is subject to separate agreement.
(7) The payout to the provider is made after receipt of the B2B invoice, usually within 30 days.
(1) For bookings of vehicles from DRM Deutsche Reisemobil Vermietung that are connected via the Rentingforce interface, Campcruisers is exclusively an intermediary.
(2) Payment is made directly to DRM by bank transfer after booking confirmation. Campcruisers is not involved in the payment processing.
(3) Campcruisers issues a subsequent commission invoice to DRM for the agreed mediation commission.
(4) The rental agreement is concluded exclusively between the lessee and DRM. DRM's rental conditions apply.
(1) Campcruisers displays leisure activities and attractions via the platform and mobile app that are provided by the partner Viator (a company of the Tripadvisor Group). Campcruisers is integrated into the Viator partner program and uses the Viator API to display offers directly in the Campcruisers interface.
(2) Technical integration: Booking is done via a payment iFrame provided by Viator, which is embedded in the Campcruisers platform. The payment process is fully handled by Viator. Campcruisers has no access to the customer's payment data and is not involved in the payment processing. A basket integration is planned for the future, where experiences can be combined with other Campcruisers services in a single booking process; in this case, Viator remains responsible for processing the experience booking.
(3) Legal position: Campcruisers is an affiliate partner of Viator, not a merchant. The contract for the leisure activity or attraction is concluded exclusively between the customer and the respective experience provider (via Viator). The terms and conditions of Viator and those of the respective experience provider, which are displayed to the customer before booking, apply.
(4) Cancellation and rebooking: Cancellations and rebookings are handled by Viator. Campcruisers provides the customer with a cancellation function within the platform that triggers the cancellation process at Viator. The decision on cancellation and any refunds is made by Viator according to the conditions of the respective experience provider.
(5) Customer service: Customer service for attraction bookings is provided by Viator. Campcruisers assists the customer in contacting Viator but is not responsible for the provision of the service or the handling of complaints.
(6) Commission: Campcruisers receives an affiliate commission from Viator for mediated bookings. This commission is paid by Viator and has no influence on the price the customer pays at Viator.
(1) As part of the booking mediation, Campcruisers transmits personal data of the customer (in particular name, email address, telephone number, booking period) to the respective provider, insofar as this is necessary for the execution of the contract.
(2) The provider undertakes to process the received personal data exclusively for the purpose of contract execution and to comply with the provisions of the General Data Protection Regulation (GDPR).
(3) Campcruisers and the provider are joint controllers with regard to the booking data within the meaning of Art. 26 GDPR. The essential contents of the agreement according to Art. 26 GDPR will be made available to the customer upon request.
(4) The provider ensures that they have their own privacy policy that meets the requirements of the GDPR.
(1) Providers undertake to indemnify Campcruisers as well as the members of the management board, employees, and other staff from any liability and all costs, including legal defense costs as well as possible and actual costs of legal proceedings and any court-imposed or imposable fines, if the aforementioned persons are held liable by third parties because the provider has culpably violated the warranties and obligations of the contract. The same applies if the liability arises from otherwise unlawful content or if a consumer protection agency or authority is involved.
(2) Any further claims for damages by Campcruisers remain unaffected.
(3) The provider is obligated to immediately and unsolicitedly provide Campcruisers with all available information about the relevant facts in a complete, organized, and written form. Campcruisers undertakes to inform the provider immediately about the claim and, as far as possible and reasonable, to give them the opportunity to defend against the asserted claim.
If a provider is dissatisfied with the services provided by us, decisions, the provisions of the General Terms and Conditions, or similar, the user undertakes to first conduct an internal complaint procedure. Complaints must be submitted to the platform operator in writing. The operator undertakes to review the complaint within 15 days and, if necessary, propose a solution.
(1) Providers are entitled to set-off or retention rights only to the extent that their claim has been legally established or is undisputed.
(2) Providers have no claim to cooperation with a specific payment provider, service provider, etc. Campcruisers may terminate the cooperation at any time and continue with other payment providers, service providers, etc. Campcruisers will act at its due discretion to weigh disadvantages for the providers and act accordingly, in particular by informing the providers in advance.
(3) If the provider is a merchant, a legal entity under public law, or a special public fund, the place of jurisdiction for all disputes arising from contractual relationships between the provider and Campcruisers is the registered office of Campcruisers (see General Terms of Use, which are part of the contract), unless there is another exclusive jurisdiction. However, Campcruisers may also choose another place of jurisdiction.
(4) Amendments or additions to the General Terms of Use and Special Provisions for Providers require written form.
(1) When a provider purchases a sponsored placement for a recreational vehicle, the Sponsored Campaign Terms accepted when entering into the contract also apply.
(2) Sponsored spaces are labelled as advertising and delivered separately from organic ranking. The supplementary terms govern fairness, prepayment, moderation, refunds, promotional grants, performance measurement and external links.
